What is the Gerrel Depo Studio?
The Gerrel Depo Studio is a mini-TV Studio designed for litigation in the Zoom, Teams, Meet, WebEx world. Its’ purpose is to make the critical points in Zoom Depositions Indelible, by transitioning juries, judges, neutrals and adjusters from being an Observer to Participant to Protagonist, through the use of strategically sequenced charts, anticipatory reading and audience participation.
Our proprietary, built-in 3-camera technique allows the attorney to toggle between a side-by-side split screen of the deponent and the attorney and a side-by-side split screen of the deponent and a document, with the attorney still in a small picture-in-a-picture box. All this is controlled with the push of 1 button. No post-production editing expenses are necessary.
Why should you Care?
- 95%+ of all depositions are currently being taken remotely on Zoom, Teams, Meet or WebEx, so the old school, in-person theatrics, to dramatize and make memorable a critical point, just don’t work on Zoom. It’s not going back to pre-COVID-19 levels.
- The average person’s attention span is now about the same as a Goldfish, 8 seconds, because the internet has so overwhelmed people with rapidly changing data.
- It is very easy for the critical points of your case to be lost in the firehose of information that must be remembered to win liability, causation & damages.
- Juries, Judges, Neutrals & Adjustors, Award ONLY what they Remember!
- Because our deepest memories are created by doing, not observing, The Gerrel Depo Studio enables the attorney though the use of strategically sequenced charts, anticipatory reading and audience participation to make the critical points indelible, by transitioning juries, judges, neutrals & adjusters from being an Observer to Participant to Protagonist.
How The Gerrel Depo Studio “O/P/P Transition” Works.
- Seven Steps to Success
The Gerrel Depo Studio O/P/P (Observer, Participant, Protagonist) Transition process is based on the neuroscience foundation that human brains are hard-wired to remember, at the highest level, those activities that we do over that which we just observe.
Think back to the dawn of humankind. Imagine a human observing another human successfully run and evade a ferocious animal. Everybody agrees that the human who successfully evaded being eaten has a stronger, deeper and more indelible memory of the event, than the human who was just observing. The successful human wasn’t just casually participating in the event, that human was the protagonist of the event.
Simply put, the goal of the Gerrel Depo Studio (GDS) is to summarize and present the critical data in a manner that facilitates that juries, judges, neutrals & adjusters will remember the data at the highest level because they have transitioned from Observer to Participant to Protagonist.
STEP 1: After the attorney identifies the critical data points that the attorney wants remembered, pre-deposition.
STEP 2: The attorney creates a Yes/No Question Chart for each critical data point. This chart summarizes that critical data point, in a series of strategically sequenced questions that will expose the deponents’ biases or their agreement with you. All of the questions must be tightly scripted and structured to produce only consistent YES or NO responses. Any response other than the consistent YES or NO response should appear to the juries, judges, neutrals & adjusters as disingenuous, shocking, and credibility challenging.
STEP 3: At the beginning of the deposition the attorney requests that the court reporting service “spotlight” both the deponent and the attorney. This will ensure that the deponent and the attorney will maintain a side-by-side split screen appearance throughout the deposition.
STEP 4: At the appropriate time during the deposition, the attorney will toggle to the document camera, that will display the YES/NO Chart in the same place, on the split screen, where the attorney previously appeared. The toggle will also simultaneously place the attorney in a small discrete picture-in-a-picture box that will be display in a lower corner of the main screen.
STEP 5: The Attorney will then proceed to slowly read each question, wait for the answer and mark the appropriate box YES or NO. The attorney continues to the next question, again slowly reading the question, patiently waiting for the answer and marking the YES or NO box.
It is during this reading of each question and patiently waiting for the deponents’ answer that the Observer, Participant, Protagonist transition takes place.
The transition is facilitated by a normal learned reflex called “anticipatory reading” or as it commonly called “reading ahead”. We all do it, because we can read faster than we can speak or listen. We do it involuntarily. Also, our attention span is short, only slightly better than a Goldfish.
- For the first one or two questions people are in the Observer stage, just reading at the pace of the attorney and getting themselves oriented in the process.
- But since all of the next questions are set forth in front of them, people start “reading ahead”, both to see what the next question is, but more importantly to see if the answers will remain consistent. When people start “reading ahead” they have transitioned to the Participant stage. They have now become part of the attorneys’ team taking the deposition. This is part of the audience participation.
- With each additional question, people become more and more energized in the Participant stage so that by the time the last few questions are being asked, the Participant has become the one asking the questions. In this final stage the Participant transitions into the attorney, becoming the Protagonist asking the questions. In the Protagonist mind the attorney is voicing the Protagonist questions. The Protagonist (aka juries, judges, neutrals & adjusters) is now doing the deposition.
- Since our deepest memories are created when we are the Protagonist of an event, having the juries, judges, neutrals & adjusters become the Protagonist in the most critical points in a deposition will significantly aid their recall when it comes to remembering critical points to win liability, causation, and damages.
STEP 6: When the attorney is finished with that specific YES/NO Chart they should mark it as an exhibit to be attached to the deposition.
STEP 7: Now the attorney can either place the next YES/NO Chart in front of the document camera, or can toggle back to their original side-by-side split screen appearance as it was at the start of the deposition.
